Fort Worth DWI Lawyer

WHAT IS DWI?

DWI stands for “driving while intoxicated.” If you are pulled over for erratic driving, speeding, or swerving, the police officer has the right to require a blood-alcohol test. Individuals who register a 0.08% blood alcohol content (BAC) or greater can be arrested for a DWI.

TEXAS DWI PENALTIES

DWI charges can come with serious consequences that could significantly impact your life. Your Fort Worth DWI lawyer can assess the details of your particular situation and develop a legal strategy that meets your needs.

Here are the typical penalties for a DWI conviction:

  • First offense: The range of punishment is from 3 days in jail up to 180 days in jail, a fine up $2000, probation up to 24 months, and license revocation for up to one year.
  • Second offense: Penalties include up to a year in jail, $4,000 maximum in fines, and up to two years without a driver’s license.
  • Third offense: A $10,000 maximum fine and 2 to 10 years of imprisonment. You may also lose your license for up to two years. A third offense is a felony, which will go on your criminal record.

There are other factors that can enhance your DWI sentence, including:

  • If a minor under 15 was present in the car during the arrest
  • Excessive BAC levels
  • An open container in the vehicle
  • The presence of controlled substances
  • Underage DWI

IGNITION INTERLOCK DEVICES

If your blood-alcohol test reveals a BAC above 0.15%, the court may require you to install an ignition interlock device in your vehicle. This means that you will need to perform a blood-alcohol test in order to turn your car on. Ignition interlock devices are mandatory for second or third DWI offenses.

FIGHTING YOUR ADMINISTRATIVE LICENSE REVOCATION (ALR)

If you are charged with a DWI, you will most likely lose your license for some time. License suspension in Texas ranges anywhere from 90 days to 2 years. If you want to challenge this suspension, you need to take action right away.

You should request a hearing with the State Office of Administrative Hearings within the first 15 days after your arrest. A Fort Worth DWI attorney can represent you. This case is separate from your criminal charges, which will be handled in a local courthouse. If you do not challenge this penalty, your suspension will start around 40 days after your initial arrest.

During a license suspension, you will not be permitted to operate any vehicle. Sometimes, the court will allow provisions such as driving to and from work with an occupational license. However, license suspension is sure to restrict your freedoms and affect your schedule.

Cole Paschall Law can obtain occupational licenses during any suspension period.
